Important Notice: Disputes, Arbitration and Governing Law

Please read the following section carefully. It outlines how any disputes between you and ECAMS will be handled. This agreement includes a requirement for individual arbitration, meaning that most disputes between you and ECAMS must be resolved through binding arbitration, unless you opt out within 30 days. Arbitration is final and replaces the need for a court trial. By purchasing, using, or engaging with any ECAMS services, you agree that any disputes will be settled through individual arbitration, and you waive your right to participate in any class action lawsuit or class-wide arbitration. If you do not agree to these terms, please stop using ECAMS services immediately.

1. ACCEPTANCE

By purchasing any services or products from ECAMS, you agree to this Agreement and consent to enter into this contract electronically.

If you are representing an entity other than a natural person, the individual who registers the account or uses our Services must have the authority to bind that entity. In this context, “you” refers to both the entity and each individual authorized to purchase our services or products.

We may update this Agreement from time to time by posting a revised version on our website. Your continued use of our Services and products constitutes acceptance of the revised Agreement.

Please review our Privacy Policy to understand the information we collect from you, how we use it, and with whom we share it.

2. OUR SERVICES

ECAMS Online Courses

1. Introduction

This policy outlines the obligations & requirements of the users, the website and website owners.

2. Accuracy

We make every effort to ensure that details about our products and services and any other information on our website are up to date. However, where information is incorrect or is subject to change, we reserve the right to withdraw or substitute the product or service and to cancel any outstanding orders or bookings with notice to you.

3. General

ECAMS develop, distribute, maintain and manage your account and products where necessary.

You shall not copy, modify, transmit, distribute, sell or in any way exploit the materials and products or any other copyrighted materials provided other than for your individual training. Any other purpose is expressly prohibited under these terms. You shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit the Products or any other copyrighted materials.

We provide the materials ‘as is’ and without any warranties, whether express or implied, except those that cannot be excluded under statute. We also do not warrant that the materials will be error free, including technical inaccuracies.

4. Grant of Licence

In consideration of your payment, we hereby grant you a licence to use the purchased eLearning courses (“the Products”). This licence is limited, revocable, non-exclusive, non-sublicensable and non-transferable, and is subject to the rights and obligations granted under these Terms.

This licence is strictly for your personal training and cannot be shared or exchanged with others.

5. Access

The start date of your personal access is deemed to be the date of your purchase.

Starting 15Mar2024, all online modules purchased will have a year of access from the date of purchase. For assess after a year, one needs to maintain an active subscription plan. We will take all reasonable steps to provide you with uninterrupted access to materials and/or products. However, your access may be restricted from time to time for reasons beyond our control. These may include power outages, interruption due to software issues, server downtime, increased in internet traffic, programming errors, regulate updates and maintenance, other locations acting outside the law such as computer hackers and other related reasons. Where this is the case, we will take reasonable steps to restore your access within a reasonable time period. 

Our aims is to provide courses, materials and products of the highest quality and as such, improvement and/or changes to the courses, materials and products may focus at any time without prior notification in order to ensure that they are up to date and accurate. 

6. Pricing and Payment

Registration prices are shown in EUR. It is always possible that, despite our best efforts to ensure prices are up to date and correct, errors may occur and in this case, you will be contacted with confirmation of the correct price before your order is completed. We reserve our right to review and change the pricing of any of our products.

We accept most major credit/debit cards for online orders. If your payment method selection is by credit card, you will be transferred to a 3rd party payment gateway where you will be asked to enter your card details and the name of the cardholder. ECAMS does not store or process your payment. If you have not received a confirmation email, you should not assume that the order has been processed. We recommend that you do not send cash through the post.

7. Online modules 

All bitesize courses purchased individually will not be entitled to be used as credits to offset your hands-on courses. Registration of hands-on courses after purchasing the online courses (of the same or different series), the full price of the hands-on course will apply. The full price is stated on our website.

8. Cancellation, Refund, and Payment Policy

8.1 Non-Refundable Payments

All fees paid for courses, digital materials, or products (“Products”) are final and non-refundable unless otherwise required under applicable law. By completing payment, you (“User”) irrevocably agree that no refunds, credits, or transfers will be issued under any circumstances, including but not limited to:

    • Change of mind or dissatisfaction with the Product,

    • Failure to access, use, or complete the Product,

    • Technical limitations (e.g., incompatible hardware/software),

    • Partial use or non-use of the purchased content.

8.2 Immediate Access – No Right to Cancel

Where Products are delivered immediately upon purchase (e.g., downloadable materials, instant course access), you waive any statutory right to withdraw or request a refund under the EU Consumer Rights Directive (2011/83/EU), Article 16(m). It is your responsibility to:

    • Verify that your system meets all technical requirements (hardware, software, internet) before purchase,

    • Acknowledge at checkout that you lose cancellation rights once digital content is made available.

8.3 No Transfers or Credits

Payments are strictly:

    • Non-transferable (may not be assigned to another person, course, or Product),

    • Non-creditable (no future discounts or balance applications).

8.4 No Chargebacks or Payment Disputes

You agree not to initiate credit card chargebacks, PayPal disputes, or other payment reversals. Violations may result in:

    • Immediate suspension of access to all Products,

    • Legal action to recover disputed amounts plus associated fees.

8.5 Limited Exceptions

Refunds will only be issued where legally mandated (e.g., if the Company cancels a Product and fails to provide a replacement).

9.  Intellectual Property

All rights, title and interest in intellectual property rights relating to the Products including copyright, patents, trademarks, trade secrets, improvements, developments, proprietary information, know-how, processes, methods, business plans or models (including computer software and preparatory and design materials thereof) and all other intellectual property (whether registered or not) developed or created from time to time shall exclusively be owned by European College of Aesthetic Medicine & Surgery, also known as ECAMS. While you may utilise the intellectual property, you understand that there shall be no transfer of ownership of the same.

Nothing that you see or read in the our courses, materials and/or products may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use.

All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorised use is prohibited.

10. Personal Data

Whilst using our website or services, you may be required to provide personal information (name, address, email, account details, etc.). We will use this information to administer our website, applications, client databases and marketing material. We will ensure that all personal information supplied is held securely in accordance with the General Data Protection Regulation (EU) 2016/679, as adopted into law of Ireland in the Data Protection Act 2018.

5. Live Model Hands-On Training Conditions
At ECAMS, we are committed to delivering a comprehensive live model hands-on training experience. However, it is important to acknowledge the inherent uncertainties involved in such training involving live models. The following are potential scenarios that may occur:

-Last minute unavailability of models due to health issues, unsuitability for the scheduled procedures, or other unforeseen reasons.

-Last minute models not attending the training session, or deciding to leave due to discomfort or second thoughts about participating.

-You may not have the opportunity to participate in all the types of cases you desire. Especially for facial surgery, breast surgery, and genital surgery—procedures that typically involve smaller, specific, and highly sensitive areas—case assignments for the participant depend on each patient’s assessment on the day of the surgery. This is based on factors like expectations, medical history, and other variables that impact patient safety and overall outcomes.

While ECAMS makes every effort to prevent these situations, they are sometimes beyond our control, and as such, we cannot assure their complete avoidance. In such instances:

-We will seek alternative arrangements to ensure the continuity and quality of training. Our team will strive to match the original training plan as closely as possible, but exact replication of the planned program cannot be guaranteed.

-Participants in these sessions should be prepared to adapt to these changes. We ask for your understanding and flexibility should any last-minute modifications be necessary.

For those participants who prefer a more predictable training scenario, we recommend choosing the “Bring Your Own Patient” option. This allows for a more controlled training environment and ensures the participant’s specific training needs are met.

6. Registration Cancellation Condition & Policy

Cancellations must be communicated in writing to: info@ecamedicine.com.

Course date after 1st June 2020:

-Cancellations until 2 months before the course: 50% processing fee on total registration.

-Less than 2 months before the course: No refund.

For the purpose of this cancellation policy, the relevant dates shall be fixed by reference to the originally scheduled date of the Course and not any newly scheduled opening date of the Course that has been changed as a result of the force majeure conditions below.

– If due to unforeseen circumstances, cancellation is requested from your side, and it is less than 2 months before the course date, please note that there will be no refund and your course fee cannot be carried over to the next course.

Course date before 31st May 2020:
– No refund.

“FORCE MAJEURE”

ECAMS shall assume no liability whatsoever in the event the training is cancelled, rescheduled or postponed OR changed in another format as a result of a “Force Majeure” event beyond its reasonable control or inadequate number of participants. For the purposes of this clause, Force Majeure events shall include, but not limited to, general and labor strikes, invasions, hostilities, war, rioting or similar situations, acts of government or state* such as lockdown and quarantine measures, immigration and transport restrictions, and acts of nature such as fires, floods, extreme weather or other emergency.

In all cases, if there is a possibility of refunds, it will be subject to a minimum deduction equal to 18% of the booking charges by way of a processing fee.

We accept most major credit/debit cards for online orders. If your payment method selection is by credit card, you will be transferred to a 3rd party payment gateway where you will be asked to enter your card details and the name of the cardholder. We recommend that you do not send cash through the post.

9. Postage and delivery

Where ceritifcate postage is applicable, the price quoted includes the cost of postage to your address. We use standard second-class post in Ireland and standard anpost mail overseas. We do not send certificate by courier or other non-standard postal method. Any additional postal costs will be clearly specified via email before the product is posted.

Whilst using our website or services, you may be required to provide personal information (name, address, email, account details, etc.). ECAMS shall assume no liability whatsoever in the event the training is cancelled, rescheduled or postponed OR changed in another format as a result of a “Force Majeure” event beyond its reasonable control or inadequate number of participants. For the purposes of this clause, Force Majeure events shall include, but not limited to, general and labor strikes, invasions, hostilities, war, rioting or similar situations, acts of government or state* such as lockdown and quarantine measures, immigration and transport restrictions, and acts of nature such as fires, floods, extreme weather or other emergency.

A – If ECAMS determines that the training needs to be cancelled as a result of a Force Majeure event or inadequate number of participants, ECAMS refund policy shall follow clause 5.
B – If ECAMS determines that the training needs to be rescheduled or postponed as a result of a Force Majeure event or inadequate number of participants, registration remains binding and participant will be entitled to participate to the rescheduled training without any further refund right.
ECAMS shall assume no further obligation to refund any travel or accommodation expenses incurred by the participant in case the event is cancelled, rescheduled or postponed as a result of a Force Majeure event or inadequate number of participants.
C – In case the training format switches from hybrid (onsite & online) to virtual (online only), and within the deadline of November 30, 2020, the registered space will be automatically switched from physical to virtual/hybrid.

GOVERNING LAW: the construction, validity and performance of the present terms are exclusively governed by the laws of Ireland without reference or regard to principles of conflicts in law. The parties submit to the exclusive jurisdiction of the courts of Ireland, located in Dublin.

*government or state means both “Ireland and the country where the concerned training is held”

11. Certified doctor code of ethics and conduct

All certified doctors are required to adhere to the ECAMS Code of Ethics and Conduct. It is essential that you familiarize yourself with these guidelines to ensure compliance. Please click on the following link to read the Code of Ethics and Conduct carefully.

12. Competence & Scope of Practice Clause

Competence, Scope of Practice & Regulatory Compliance

ECAMS provides postgraduate, skills-based training intended exclusively for licensed medical practitioners. All programmes are designed to enhance clinical knowledge, practical ability, and procedural understanding through structured education, hands-on training, supervised practice, and evidence-based methodologies.

Completion of any ECAMS course, workshop, fellowship, masterclass, or certification does not, by itself, grant legal competence or authorisation to perform any medical procedure. Competence to practise a procedure is defined solely by the participant’s local medical regulatory authority, licensing board, health ministry, or institutional privileges.

Participants remain fully responsible for:

    • ensuring that any procedure they choose to perform is within their legally permitted scope of practice;

    • complying with the laws, guidelines, and regulatory requirements of their country or region;

    • exercising independent professional judgement and maintaining patient safety at all times;

    • obtaining any additional supervised clinical experience required by their regulator or institution before performing procedures independently.

ECAMS training equips participants with the knowledge, technical skills, clinical frameworks, and safety principles necessary to enhance their practice within their permitted scope, but ECAMS cannot guarantee, certify, or confer regulatory “competence” as defined by external authorities.

By completing registration, participants accept that ECAMS programmes are educational in nature and do not replace local licensing requirements, specialist training pathways, or jurisdiction-specific credentialing processes.

ECAMS TERMS AND CONDITIONS

Associate Membership & Clinical Club

By applying for or maintaining access to ECAMS Associate Membership or Clinical Club, the applicant agrees to comply with the following Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following definitions apply:

  • “ECAMS” means the European College of Aesthetic Medicine and Surgery.

  • “Website” means www.ecamedicine.com

  • “Member” means any individual accepted into an ECAMS Membership or Clinical Club.

  • “Associate Membership” means general ECAMS membership not linked to hands-on course qualification.

  • “Clinical Club Alumni/Fellow” means privilege access available exclusively to doctors who have successfully completed or will be completing ECAMS hands-on training programmes.

  • “Fellowship Privilege Circle” means privilege access available exclusively to doctors who have completed and progressed through ECAMS Fellowship pathways.

  • “Privilege Access” means qualification-based professional access, not a public subscription or entitlement.

  • “Credit” means a non-cash educational credit issued by ECAMS, redeemable only under specific conditions defined herein.

  • “Logo” means any ECAMS logo or fellow logo.

2. Application & Acceptance

All applications for ECAMS Associate Membership or Clinical Club must be submitted via the Website or through ECAMS-authorised channels.

By submitting an application, purchasing access online, or renewing access, the applicant confirms that:

  • All information provided is accurate, complete, and current

  • They have read, understood, and agreed to these Terms and Conditions

ECAMS reserves the absolute right to:

  • Accept or reject any application

  • Limit the number of Members or Privilege Holders

  • Determine eligibility based on internal Membership and Privilege Guidelines

No application shall be processed until the applicable fee (where relevant) has been received.

3. Nature of Membership & Privilege Access

ECAMS offers different access categories, including:

  • Associate Membership

  • Clinical Club – Alumni

  • Clinical Club – Fellow

Alumni and Fellowship access are not subscriptions and are not open to the public.

They are professional privileges granted based on:

  • Training completion

  • Qualification status

  • Alignment with ECAMS standards

Access does not constitute:

  • Employment

  • Partnership

  • Agency

  • Guarantee of faculty appointment or compensation

4. Benefits & Conduct

Members may access benefits applicable to their category, as published on the Website or communicated by ECAMS.

All Members must:

  • Uphold the highest professional and ethical standards

  • Comply with applicable laws and regulations

  • Act with integrity, transparency, and responsibility

Members must not:

  • Misrepresent their relationship with ECAMS

  • Use ECAMS logos or titles without written authorisation

  • Disclose confidential or proprietary information

  • Defame or unfairly criticise ECAMS, its faculty, or other Members

5. Clinical Club Privilege 

ECAMS reserves the right to:

  • Refused or reject a Member based on eligibility

  • Transition Members between Associate membership to Alumni, or Fellow status

  • Modify the membership or privilege structure as required

Any changes take effect from the next renewal or review period.

6. Fees & Administrative Charges

All applicable fees are payable in advance and may include:

  • Membership fees

  • administrative fees

Fees support verification, governance, digital access, and institutional infrastructure.

All fees are non-refundable, unless explicitly stated otherwise.

7. Duration, Renewal & Cancellation

Associate Membership or Clinical Club is granted for a 12-month term and renews automatically unless cancelled.

Cancellation Policy

Members must notify ECAMS by email at info@ecamedicine.com before the next automatic deduction is processed.

  • If notification is received before the next scheduled deduction, cancellation will take effect at the end of the current term.

  • If the renewal fee has already been deducted, cancellation will apply from the next renewal date only.

  • No refunds will be issued for fees already deducted.

Termination results in immediate loss of all benefits at the end of the paid term.

8. Return Refresher Course Privilege

Where ECAMS restructures or expands a previously completed course (e.g. to a new two-day format), eligible Alumni and Fellows may:

  • Rejoin the updated programme

  • Access the course at a reduced privilege return rate, where applicable

This privilege:

  • Applies only to courses previously completed

  • Does not imply requalification

  • Is subject to availability and internal eligibility

9. Code of Ethics & Conduct

All certified doctors, Alumni, Fellows, and faculty-affiliated Members must comply with the ECAMS Code of Ethics and Conduct.

Failure to comply may result in suspension or termination of Membership or Clinical Club Access.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Ireland.

The fellowship programme must be complete in 24 months period from the date of your first hands-on course. Extension is possible only through written email info@ecamedicine.com and submission of the extension form. Any changes we may make to these terms and conditions at any time will be posted on this page. Please check back frequently to see any updates or changes we have made.

3. Our quotation to you

Please note that all quotation is valid for only 14 days and it is by no means a legal binding contract.

The purchases of the hands-on courses’ the terms and conditions will still apply (to read more, under this page please click on “ECAMS Hands on Courses”).

To join the fellowship programme, one has to maintain an active ECAMS clinical fellow club member at €1500/year. Maintain an active clinical club  is a commitment to complete the fellowship programme.

4. Your Clinical Club membership

Clinical club membership is non-refundable and non-transferrable.

5. Accuracy

We make every effort to ensure that details about our products and services and any other information on our website are up to date. However, where information is incorrect or is subject to change, we reserve the right to withdraw or substitute the product or service and to cancel any outstanding orders or bookings with notice to you.

Program and paths are subjected to change to ensure training quality standards. 

6. Registration Cancellation Condition & Policy

For cancellation of your fellowship, please see the following:

  • Cancellation must be notified in writing by email uniquely to: info@ecamedicine.com
  • If you had already availed to any of the hands-on courses using the fellowship discounted fee, regardless of the number of courses you had availed to, your clinical club membership will not be refunded.
  • Please note that all online and hands-on course fee are subject to changes.

7. Payment

We accept most major credit/debit cards for online orders. If your payment method selection is by credit card, you will be transferred to a 3rd party payment gateway where you will be asked to enter your card details and the name of the cardholder. ECAMS do not store or processed your payment. If you have not received a confirmation email, you should not assume that the order has been processed. We recommend that you do not send cash through the post.

8. Pricing

Registration prices shown in EUR. It is always possible that, despite our best efforts to ensure prices are up to date and correct, errors may occur and in this case you will be contacted with confirmation of the correct price before your order is completed.

9. Personal information

Whilst using our website or services, you may be required to provide personal information (name, address, email, account details, etc.). We will use this information to administer our website, applications, client databases and marketing material. We will ensure that all personal information supplied is held securely in accordance with the General Data Protection Regulation (EU) 2016/679, as adopted into law of the Ireland in the Data Protection Act 2018.

GOVERNING LAW: the construction, validity and performance of the present terms are exclusively governed by the laws of Ireland without reference or regard to principles of conflicts in law. The parties submit to the exclusive jurisdiction of the courts of Ireland, located in Dublin.

  1. Model selection

    ECAMS work with Local Responsible Doctors where our trainings are held in their local facility or clinic. We occasionally offer opportunities for live models to participate in our live-model training sessions.

    Please note that your suitability as a model will be determined by the Local Responsible Doctor and ECAMS contracted trainers.

    The Local Responsible Doctors and the trainer retain the right to limit or restrict model appointments in situations where there are excessive or unreasonable short-notice cancellations or Did Not Attend, or when a patient’s expectations are deemed unrealistic and therefore unsuitable for a training environment.

    ECAMS requires live model to sign a release document prior to your treatment. Please read through the document carefully.

  2. Treatment Fees

    As a live model at our trainings, the Local Responsible Doctor may require you to pay for the treatment fee either at no cost or at a reduced cost.

    This fee will be dealt with directly by the Local Responsible Doctor and it may vary depending on the type of procedure, its location, and other factors related to the treatment.

    Advanced payment may be required to secure your participation for both local and international participating models. On occasion, in order to confirm participation, Local Responsible Doctors may require models to make payments through ECAMS.

    It is imperative to acknowledge that this payment is not intended as a revenue for ECAMS, nor does it denote ECAMS assuming responsibility for the treatment received. Any payments made through ECAMS will be reimbursed to the Local Responsible Doctor responsible for the training procedure.

    In such cases, models may choose to pay for their treatment through cash, credit/debit card, or bank transfer.

    In the event that a surgical or non-surgical procedure must be repeated, whether due to complications or the failure to meet the model’s desired results, the model agrees to bear the cost of the facility, consumables, products, and medical support staff fees at cost for any subsequent procedures required during the next training session.

    The models further understand that in the event of an unforeseen complication arising during a surgical or non-surgical procedure, their safety is of utmost importance, and as a result, the desired results may be compromised.

    Any additional costs resulting from such complications are the sole responsibility of the model. All additional cost should be dealt with directly with Local Responsible Doctor.

  3. Follow up

    The Local Responsible Doctor bears the responsibility for all post-treatment follow-up and aftercare. Participants are advised to consult with the Local Responsible Doctor to obtain necessary follow-up instructions.

    In some instances, the Local Responsible Doctor may coordinate with ECAMS to communicate follow-up details.

3. DISPUTES, ARBITRATIONS, AND GOVERNING LAW

If you have any disputes with ECAMS related to our services, products, or this Agreement, we strongly encourage you to contact us first to seek an amicable resolution. However, if the dispute cannot be resolved informally, the following terms apply:

  • Governing Law: This Agreement, and any disputes or claims arising from or related to it, will be governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law principles.

  • Jurisdiction: All legal proceedings arising out of or in connection with this Agreement or your use of our services or products shall be brought exclusively in the courts of the Republic of Ireland. You agree to submit to the exclusive jurisdiction of these courts and waive any objections to venue in these courts.

  • Optional Arbitration: In the event of a dispute, you and ECAMS may mutually agree to resolve the dispute through arbitration. Arbitration is a private and binding process that can be quicker and more confidential than court litigation. If both parties agree to arbitration, it will be conducted in the Republic of Ireland according to the laws of the Republic of Ireland. The decision of the arbitrator will be final and binding, with limited options for appeal. However, if either party prefers, the dispute may instead be resolved through the Irish courts as outlined above.

  • No Class Actions: You agree to resolve any disputes with ECAMS on an individual basis. You hereby waive your right to participate in any class action lawsuit or class-wide litigation against ECAMS. This means any dispute you have with us must be resolved individually, and not as part of a group or collective action.
